5. Descargo de responsabilidad de salud

Ni HYPNOTIC TAKEOFF UNIVERSAL LLC, ni Jacobo.soy, ni Juan Jacobo Ramos García son proveedores de servicios médicos, psiquiátricos o psicológicos.
Nada de lo ofrecido en el SITIO WEB, en las sesiones de hipnosis o en los cursos gratuitos debe interpretarse como diagnóstico, tratamiento, prevención o cura de enfermedades físicas o mentales, ni como sustituto de la atención médica o terapéutica profesional.

El USUARIO se compromete a:

• Consultar con su médico o profesional de la salud antes de iniciar procesos de hipnosis si presenta enfermedades físicas o mentales, se encuentra bajo medicación o tratamiento, o tiene dudas sobre su estado de salud.
• No suspender, modificar ni sustituir tratamientos médicos, psicológicos o psiquiátricos por la información o experiencias derivadas de las sesiones o contenidos de Jacobo.soy.

El USUARIO entiende y acepta que no debe ignorar ni retrasar la búsqueda de consejo médico profesional debido a cualquier información o experiencia obtenida a través del SITIO WEB o de los SERVICIOS.

6. Certificaciones profesionales y códigos de ética

Las sesiones de hipnosis ofrecidas a través de Jacobo.soy son facilitadas por Juan Jacobo Ramos García, profesional certificado por el International Certification Board of Clinical Hypnotherapy (ICBCH) y la International Hypnosis Association (IHA).

Como miembro certificado, Jacobo Ramos se compromete a actuar en coherencia con los códigos de ética, normas de conducta profesional y demás lineamientos legales aplicables de dichas asociaciones, lo que incluye, entre otros aspectos, el respeto a la autonomía del cliente, la confidencialidad, la honestidad en la presentación de credenciales, la claridad en honorarios y condiciones de servicio, y el reconocimiento de los límites de la hipnosis, remitiendo al USUARIO a otros profesionales de la salud cuando sea necesario.

El USUARIO entiende que estos códigos de ética complementan, pero no reemplazan, las leyes civiles, penales, sanitarias y de consumo aplicables en las jurisdicciones que correspondan, las cuales seguirán prevaleciendo en caso de conflicto.

7. Mayores de edad y responsabilidad de tutores

Los SERVICIOS están dirigidos exclusivamente a personas mayores de 18 años.
Cualquier excepción para menores de edad requerirá el consentimiento por escrito y la supervisión de su padre, madre o tutor legal, quien asume la completa responsabilidad por la participación del menor y por los resultados de las sesiones.

El USUARIO se compromete a utilizar el SITIO WEB y los SERVICIOS de forma respetuosa, lícita y coherente con el propósito de bienestar y desarrollo personal que inspira la obra de Jacobo Ramos.

El USUARIO es responsable de mantener la confidencialidad de sus credenciales de acceso y de todas las actividades realizadas a través de su cuenta, y se compromete a notificar a LA EMPRESA cualquier uso no autorizado.

10. Reserva de sesiones, precios y condiciones económicas

En el SITIO WEB se ofrecen:

• Sesiones de hipnosis (individuales o grupales, presenciales u online, según se especifique).
• Cursos gratuitos y otros materiales sin costo.

Cuando exista un precio, este se mostrará claramente antes de la confirmación de la reserva, incluyendo la moneda y, cuando aplique, los impuestos y cargos adicionales.
Al completar el proceso de reserva y pago, el USUARIO formaliza una relación contractual con HYPNOTIC TAKEOFF UNIVERSAL LLC, bajo la marca Jacobo.soy, en los términos específicos establecidos para cada servicio.

11. Política de cancelación, reprogramación y reembolsos

El USUARIO se compromete a respetar los horarios de las sesiones reservadas.
Salvo que el SITIO WEB indique otra cosa de forma específica, aplicará lo siguiente:

• Cancelaciones con al menos 24 horas de anticipación: el USUARIO podrá reprogramar su sesión sin costo adicional, sujeta a disponibilidad de agenda.
• Cancelaciones con menos de 24 horas de antelación o inasistencia (“no show”): se considerará que la sesión se ha utilizado y no habrá reembolso ni reprogramación gratuita, salvo decisión expresa de LA EMPRESA.
• Reembolsos: cuando proceda un reembolso según la política específica de cada programa o sesión, se realizará por el mismo medio de pago utilizado originalmente, dentro de un plazo razonable.

HYPNOTIC TAKEOFF UNIVERSAL LLC y Jacobo Ramos se reservan el derecho de cancelar o reprogramar una sesión por motivos de fuerza mayor o circunstancias excepcionales, comprometiéndose a notificar al USUARIO y a ofrecer una nueva fecha o un reembolso cuando corresponda.

12. Pagos y procesadores externos

Los pagos por sesiones u otros servicios de pago, cuando existan, podrán gestionarse a través de procesadores de pago de terceros (por ejemplo, Stripe, Square, Payoneer, PayPal u otros indicados en el SITIO WEB).
El tratamiento de los datos de pago se rige por las políticas de privacidad y seguridad de dichos terceros; HYPNOTIC TAKEOFF UNIVERSAL LLC y Jacobo.soy no almacenan datos completos de tarjetas de crédito o débito en sus servidores.

13. Consentimiento informado para hipnosis

Al reservar y participar en una sesión de hipnosis con Juan Jacobo Ramos García, el USUARIO declara que:

• Comprende que pueden surgir respuestas emocionales intensas, recuerdos o “insights” y que la sesión no sustituye procesos médicos o terapéuticos profesionales.
• Participa de forma libre y voluntaria y puede interrumpir su participación en cualquier momento, informando al facilitador.

El USUARIO reconoce que es plenamente responsable de su bienestar antes, durante y después de las sesiones, así como de las decisiones personales que tome a partir de las mismas.

Además, Jacobo Ramos se compromete a ofrecer los SERVICIOS dentro de los límites establecidos por su formación, certificaciones y los códigos de ética del ICBCH y de la IHA, evitando prometer curas, diagnósticos o resultados garantizados y manteniendo la confidencialidad y el respeto a la dignidad del USUARIO en todo momento.

14. Propiedad intelectual

El Método de Despegue Hipnótico®, el nombre Jacobo.soy, así como los textos, audios, videos, meditaciones, imágenes, diseños, logotipos, descargables y demás contenidos del SITIO WEB son propiedad de HYPNOTIC TAKEOFF UNIVERSAL LLC y/o de Juan Jacobo Ramos García, o se utilizan con la licencia correspondiente.
Queda prohibida la reproducción, distribución, comunicación pública, transformación, venta o cesión de dichos contenidos sin autorización previa y por escrito de LA EMPRESA.

Se permite al USUARIO el uso personal, privado y no comercial de los contenidos, manteniendo intactos los avisos de propiedad intelectual y sin alterar su naturaleza.

15. Confidencialidad de las sesiones

HYPNOTIC TAKEOFF UNIVERSAL LLC, Jacobo.soy y Jacobo Ramos se comprometen a tratar con confidencialidad la información compartida por el USUARIO en las sesiones, salvo:

• Cuando el USUARIO otorgue consentimiento expreso para compartir ciertos aspectos (por ejemplo, testimonios, siempre de forma anónima salvo autorización).
• Cuando exista una obligación legal de revelar información (por ejemplo, riesgo grave e inminente para la vida o la integridad del propio USUARIO o de terceros, o requerimientos de las autoridades competentes).

En sesiones online, el USUARIO acepta que la confidencialidad también depende de las condiciones del entorno físico y tecnológico en el que se conecta.

Este compromiso de confidencialidad y de uso cuidadoso de la información personal forma parte también de las obligaciones éticas asumidas por Jacobo Ramos ante el ICBCH y la IHA.

16. Enlaces y contenidos de terceros

El SITIO WEB puede incluir enlaces a páginas web, productos o servicios de terceros.
HYPNOTIC TAKEOFF UNIVERSAL LLC, Jacobo.soy y Jacobo Ramos no controlan ni son responsables del contenido, las políticas o las prácticas de dichos sitios, por lo que el acceso a ellos es bajo la exclusiva responsabilidad del USUARIO.

Estos TÉRMINOS, junto con el Aviso de Privacidad y cualesquiera condiciones particulares aplicables a programas específicos, constituyen el acuerdo íntegro entre el USUARIO y HYPNOTIC TAKEOFF UNIVERSAL LLC respecto al uso del SITIO WEB y de los SERVICIOS.
Si alguna disposición fuese declarada nula, ilegal o inaplicable, dicha nulidad no afectará la validez del resto de las disposiciones, que permanecerán plenamente vigentes.

The USER understands that these codes of ethics complement, but do not replace, applicable civil, criminal, health, and consumer protection laws, which will prevail in the event of a conflict.

7. Adults Only and Responsibility of Guardians

The SERVICES are intended exclusively for individuals who are 18 years of age or older.
Any exception for minors requires written consent and supervision by a parent or legal guardian, who assumes full responsibility for the minor’s participation and for the results of the sessions.

11. Cancellation, Rescheduling, and Refund Policy

The USER agrees to respect the scheduled time of any booked session.
Unless otherwise stated on the WEBSITE for a specific program, the following applies:

• Cancellations made at least 24 hours before the session: the USER may reschedule the session at no additional cost, subject to availability.
• Cancellations made with less than 24 hours’ notice or no-shows: the session will be considered used, and no refund or free rescheduling will be offered, unless expressly decided by the COMPANY.
• Refunds: Where a refund is applicable under the specific policy of a program or session, it will be issued to the original payment method within a reasonable timeframe.

Furthermore, Jacobo Ramos commits to providing the SERVICES within the limits of his training, certifications, and the codes of ethics of ICBCH and IHA, avoiding promises of cures, diagnoses, or guaranteed results, and maintaining confidentiality and respect for the USER’s dignity at all times.

14. Intellectual Property

The Hypnotic Takeoff Method™, the name Jacobo.soy, as well as texts, audios, videos, meditations, images, designs, logos, downloads, and other contents of the WEBSITE are the property of HYPNOTIC TAKEOFF UNIVERSAL LLC and/or Juan Jacobo Ramos García, or are used under the corresponding license.
The reproduction, distribution, public communication, transformation, sale, or transfer of such contents is prohibited without prior written authorization from the COMPANY.

The USER is allowed to use the contents solely for personal, private, non‑commercial purposes, keeping all intellectual property notices intact and without altering the nature of the contents.

The USER agrees to indemnify, defend, and hold harmless HYPNOTIC TAKEOFF UNIVERSAL LLC, Jacobo.soy, Juan Jacobo Ramos García, and their collaborators from any claim, demand, loss, damage, cost, or expense (including reasonable attorneys’ fees) arising from the USER’s misuse of the WEBSITE or breach of these TERMS.

The USER understands that, for online services, additional or different rules may apply in their local jurisdiction, especially regarding health, hypnosis, and tele‑practice, and is responsible for being aware of and complying with them.

23. Amendments to the Terms and Conditions

HYPNOTIC TAKEOFF UNIVERSAL LLC reserves the right to modify these TERMS at any time.

24. Termination

HYPNOTIC TAKEOFF UNIVERSAL LLC may suspend or cancel the USER’s access to the WEBSITE and/or SERVICES in case of breach of these TERMS, suspected fraudulent use, or conduct contrary to the spirit of respect and well-being that guides the Jacobo.soy activity.
Termination does not release the USER from obligations already due, such as outstanding payments or sessions already consumed.
